Montana Auctioneer
Requirements
Montana does not require a state issued license to work as an auctioneer. Montana law does require every auctioneer to file a $5,000 surety bond with the clerk of the county where they live before conducting business. There is no state auction exam and no licensing board.
Requirements Checklist
- No state auctioneer license or exam. Montana has no state board overseeing auctioneering.
- A $5,000 surety bond is mandatory, filed with the clerk of the county where the auctioneer resides, under Montana Code Annotated Section 30-11-510.
- The bond protects the public against financial harm if an auctioneer breaches a consumer contract or fails to deliver goods that have been paid for, under Section 30-11-508.
- Auction terms must be publicly announced before the auction begins, under Montana Code Annotated Title 30, Chapter 11.
- Local business or tax licenses may still apply. Montana's municipal authorities can require a local business or tax license separate from the state's bonding requirement.
Step by Step Process
- Obtain a $5,000 surety bond through a licensed bonding company.
- File the bond with the clerk of the county where you live, as required under Montana Code Annotated Section 30-11-510.
- Check with your city or county for any local business or tax license that may apply in addition to the state bonding requirement.
- Prepare to publicly announce your auction terms before each auction begins, as Montana law requires.
- Build your professional skills. Montana does not test auctioneers, but strong local reputation and professional competence are what sellers and buyers actually rely on.
Why Education Still Matters Without a Licensing Exam
Montana does not require a state exam, but the fundamentals, including the chant, contract handling, ethics, and running a professional auction business, are what sellers and buyers need from a professional auctioneer. Montana auctioneers play a significant role in their communities, where strong local reputation and professional competence matter as much as anywhere in the country.
